What is transfer duty in South Africa?

Transfer duty is a tax under the Transfer Duty Act 40 of 1949 on the purchase of fixed property, paid by the buyer. It's calculated on the higher of the purchase price or the property's market value.

What is the transfer duty threshold for 2026?

No transfer duty is payable on property valued at R1,210,000 or less. This applies to all buyers — there is no separate first-time buyer exemption in South Africa.

When do I not pay transfer duty?

Transfer duty doesn't apply to transactions subject to VAT — typically new developments sold by a VAT-registered developer, where the buyer effectively pays VAT instead. The seller must give SARS proof of VAT before an exemption is issued.

Is transfer duty the only cost when buying property?

No. You also pay a conveyancing attorney's fee (plus VAT) and a Deeds Office registration fee. Transfer duty is fixed by law; the attorney's fee is quoted per transaction.
